La ultraactividad de las leyes en materia contractual
Análisis del último párrafo del artículo 7 del Código Civil y Comercial
Abstract
The only temporary provision of a general nature present in the Argentine Civil and Commercial Code is included under section 7 of said Code. It reaffirms the principles established by section 3 of the abrogated Civil Code, with an amendment to consumer contracts though. In consideration of jurisprudence and doctrine on the matter, this paper analyses the last paragraph of section 7 in relation to the applicability of new default rules through time. The question is approached concerning not only its connection to the majority of contracts but also to pre-contractual negotiations, preliminary contracts and consumer contracts.
