Prescripción de la acción de simulación respecto de terceros

Abstract

The problem related to the statutory limitation of the simulation action, when it is attempted by third parties, is analyzed in this paper. Two aspects are to be considered: the time limit for the legal action, considering that the action may be brought alone or together with other actions, and the initial moment of such time limit. In the analysis section, the different doctrinal and judicial precedent positions are highlighted. Also, a brief reference to the solution provided by the Civil and Commercial Code of Argentina is mentioned.
