Regarding a ruling from Room “C” of the National Court of Commercial Appeals
Abstract
This article analyzes the main arguments put forth by the “C” Room of the National Court of Appeals in Commercial Matters in the case GARANTIZAR S.G.R. v. DIB, ALBERTO EDUARDO AND ANOTHER s/EXECUTIVE, where the National Commercial Court determined that a consumer relationship exists in the reciprocal guarantee contract between a participating partner and the reciprocal guarantee society, solely based on the use given to the assets acquired through the guaranteed bank loan.
