The impact of inflation on the offence of smuggling
Abstract
The goal of this essay is to analyze the impact of inflation in defining the offence of smuggling, in accordance to the value stablished by Congress to differentiate it from the customs contravention (art. 947 of Customs Code). In this essay we will address the legislative and case-law developments of this matter, linking the concept of 'economic significance' of goods with the price distortion phenomenon and potential harm to constitutional rights. Finally, we will analyze a few solutions issued by courts to address the problem, seeking to prevent the offence of smuggling from extending its scope to trivial matters unwanted by the legislator.
